Terms of Use

Gemino is an AI-powered authenticity reasoning engine. You upload photos of a physical product; our systems return a verdict (e.g. likely authentic, likely counterfeit, insufficient evidence), a confidence score, and a set of forensic signals with explanations. Reports may be published to a public URL you can share.

• You must be at least 16 (or the higher age required by your local law) to create an account.
• You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
• You agree to provide accurate information and to keep it up to date.

• Guest: up to 1 scan without an account.
• Free account: up to 5 lifetime scans per verified identity, subject to anti-abuse checks.
• Unlimited: a paid subscription billed through Paystack. Prices, currency and billing frequency are shown on the checkout page.
• Subscriptions renew automatically until cancelled from your account settings. Cancellations take effect at the end of the current billing period.
• Except where required by law, payments are non-refundable. Donations are always non-refundable.
• We may change prices with at least 14 days' notice, effective from your next billing period.

You agree not to:

• Upload content you don't have the right to share, including copyrighted images, trade secrets, or personal data of others without a lawful basis.
• Attempt to reverse-engineer, scrape at scale, or evade the free-tier limits, fraud detection, or rate limiting.
• Use Gemino to harass, defame, extort, or make unlawful accusations about identifiable people or businesses.
• Submit CSAM, terrorism content, or content that violates any law.
• Use Gemino verdicts as the sole basis for enforcement, prosecution, seizure, or public accusation of a specific seller.
• Interfere with the security or integrity of the Service.

We may investigate and act on suspected violations, including removing content and suspending accounts.

You retain ownership of the photos and information you submit ("User Content"). You grant Gemino a worldwide, royalty-free licence to host, store, reproduce, adapt, and display User Content solely to:

• Run the AI analysis you requested.
• Generate and display the resulting report, including at its public URL if you choose to share it.
• Detect fraud and abuse.
• Improve Gemino using de-identified/aggregated signals.

You warrant that (a) you took, own, or have permission to share each photo, and (b) publishing your report will not infringe third-party rights or laws.

Gemino reports are automated opinions produced by AI vision models. They are not laboratory tests, forensic certifications, customs determinations, or legal advice. A verdict of likely counterfeit is a probabilistic estimate — not a legal finding of counterfeiting. A verdict of likely authentic is not a guarantee.

Do not rely on a Gemino report as the sole basis for a purchase decision, dispute, or enforcement action. Where appropriate, seek an independent authentication service, the brand owner, or a qualified professional.

• Brands and rights-holders may register a product ("Register Your Product") or claim an existing report ("Claim this Product") by submitting verification documents.
• We review claims in good faith but do not guarantee any turnaround time.
• To request removal of content that infringes your rights (e.g. DMCA / EU DSA notices, defamation claims), email legal@geminotrust.com with (i) identification of the content and URL, (ii) proof of your rights, (iii) a statement of good-faith belief, (iv) your contact details, and (v) a signature. We may forward the notice to the uploader.

The Gemino name, logo, website, software, models, and prompts are owned by Gemino or its licensors and are protected by intellectual-property laws. Nothing in these Terms transfers any of our IP to you except a limited, revocable, non-exclusive licence to use the Service as intended.

Gemino uses third-party providers including Supabase, Cloudflare, Paystack, and the Lovable AI Gateway (Google Gemini). Your use of those services through Gemino is subject to their terms and privacy policies. We are not responsible for third-party outages or acts.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT REPORTS WILL BE ACCURATE, COMPLETE, OR ERROR-FREE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEMINO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR REPUTATION, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100.

NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW (INCLUDING LIABILITY FOR DEATH, PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR CONSUMER-PROTECTION LAW RIGHTS).

You agree to indemnify, defend, and hold harmless Gemino from and against any claim, loss, liability, or expense (including reasonable legal fees) arising out of (a) your User Content, (b) your breach of these Terms, or (c) your misuse of a report.

We may suspend or terminate your access to the Service, remove content, or refuse a scan at any time if we reasonably believe you have violated these Terms, our anti-abuse policies, or applicable law. You may stop using the Service and delete your account at any time by emailing privacy@geminotrust.com.

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to its conflict-of-laws rules. The courts of Lagos State have exclusive jurisdiction, save that either party may seek injunctive relief in any competent court. If you are a consumer in the EU/UK, you also benefit from mandatory protections of the law of your country of residence.

Nothing in these Terms limits statutory consumer rights that cannot be waived, including EU/UK withdrawal rights for digital services and remedies for defective services.

We may update these Terms from time to time. Material changes will be posted here with a new effective date and, where required, notified to registered users. Continued use of the Service after changes take effect constitutes acceptance.
